The UP Population Law proposal has been prepared by the State Law Commission. Through which suggestions for legal measures have been provided for population control in Uttar Pradesh. This proposal has been uploaded on the website and public opinion has been sought on this proposal by 19 July 2021. After considering the opinion received by the Commission, this proposal will be submitted to the Government. Various types of facilities are being provided to the parents with two or less than two children in the UP Population Act proposal and a provision has been included to deprive the parents of more than two children from many facilities. If this proposal is implemented then all those people who will help in population control will be encouraged by the government.

In the case of having more than two children, from applying for a government job to contesting the local body elections, there can be a ban. A provision has also been included in this proposal to deprive citizens who violate the law from 77 government schemes and grants.

If the UP Population Act proposal is implemented then in this situation the following incentive amount will be provided to the law abiding citizens.

Incentives for Public Servants (two children):

All those civil servants who voluntarily sterilize themselves or their spouses after the birth of two children will be provided the following benefits.

  • 2 additional increments during the entire service
  • Subsidy on purchase of plot or house site or manufactured house from Housing Board
  • Soft loan for construction of house at very low interest rate
  • Exemption on utility like water, electricity, house tax etc.
  • 12 months leave on the birth of child with full pay and allowances
  • Employer Contribution Fund under National Pension Scheme increased by 3%
  • Free health care facility and insurance coverage to the spouse

Incentives for Public Servants (One Child):

All those civil servants who voluntarily sterilize themselves or their spouses after the birth of a child will be provided the following benefits.

  • 2 additional increments during the entire service
  • Free health care facility and insurance coverage for the child till the age of 20 years
  • Priority in granting admission to the child in other educational institutions including Indian Institute of Management, All India Institute of Medical Science etc.
  • free education up to graduation level
  • Scholarship to Girls for Higher Studies
  • priority in government job etc.

Incentives to the general public (two children):

All those common citizens who are not public servants and after the birth of two children get themselves or their husband or wife sterilization of their own free will, they will be provided the following benefits.

  • Soft loan for construction of house at very low interest rate
  • Exemption on utility like water, electricity, house tax etc.
  • 12 months leave on the birth of child with full pay and allowances

Incentives to the general public (one child):

Some of the main benefits to the family living below poverty line

If the UP Population Act is implemented, then all the citizens who live below the poverty line and after the birth of a child get themselves or their husband or wife sterilised, they will be given a lump sum amount by the government. The provision of the UP Population Act has been given under the proposal. If the child is a boy then this lump sum amount will be 80000 rupees and if the child is a girl then this lump sum amount will be 100000 rupees.

stipulation for non-compliance of UP population law

All those citizens who will not follow the UP Population Act will not be provided any incentive. Along with this they will have to face the following discouragement.

  • Citizens who do not follow the law can be thrown out of government schemes.
  • Only four members can be included in the ration card.
  • The benefit of government grant will also not be provided
  • Debarred from contesting local body elections.
  • will not be able to apply for government jobs
  • Government employees will not be given promotion

Jansankhya Kanoon ‘s exception

The following exceptions will be included if the UP Population Act is implemented.

  • Multiple births from second pregnancy
  • If a person has two children on his own and the third child is adopted
  • Disability status of the first or second child
  • death of the first, second or both children
  • A couple who at the time of the commencement of this Act is pregnant with a third child
  • polygamy status

Responsibilities of the Government for the implementation of the UP Population Act

If the UP Population Act is implemented then the government will have to fulfill the following duty.

  • To amend this scheme from time to time by the government.
  • Establishment of maternity centers at all primary health care centres.
  • To spread awareness about family planning method.
  • Ensuring registration of pregnancy, delivery, birth and death.
  • Giving iron and vitamin capsules to pregnant women.
  • Vaccination of children on time.
  • To spread information about the benefits of small family to the people.
  • Addition of Population Control subject in school curriculum by Govt.
  • The government will also have to ensure that preventive measures are made available to the citizens of the state.
  • In case the sterilization operation is not successful due to any reason, an insurance cover of ₹ 50000 will be provided.
  • If the child is born due to the lack of sterilization operation, then in this situation the UP Population Act will not be considered as a violation and all the benefits will be provided to the couple.
  • A State Population Fund will also be set up through which the implementation of this scheme will be done.

Special provision in case of polygamy

A special provision has been made for polygamy in the proposal of the UP Population Act. If this law is applicable, then a special provision has been prescribed for a couple having more than one marriage under religious or personal law. Under which if a person marries more than one and has more than two children from all the wives, then the husband will be deprived of all the facilities but the wife will be provided the benefit of all the facilities. If the woman marries more than one and she has more than two children from all the husbands, then in this situation the woman will be deprived of the facilities but all the facilities will be provided to her husbands.
